One foundation, two systems – Austria and Liechtenstein in focus

In both Liechtenstein and Austria, the foundation is one of the most popular instruments for asset protection, structuring and intergenerational succession planning. Although the two countries have mutually inspired each other with regard to shaping their legal systems, thereby resulting in the two having a number of ‘cross-border' similarities, there are nevertheless some significant differences to bear in mind. Even in cases with a broadly similar set of circumstances, legal practitioners often reach different conclusions depending on which side of the (not overly long) national border they are on.

At this event, Prof. Dr Nowotny and Dr Schwarz will explore these special features and take a practical look at the relevant case law of the respective supreme courts. By examining a selection of decisions, they will highlight where the foundation models of the two countries converge, where they diverge, and what implications this may have for foundation stakeholders.
