The 23rd Annual Forum for Law and Tax (RuSt 2019) organised by Business Circle was held in Rust on 17 and 18 October 2019 – the event for Austria's leading legal and tax experts.
During the opening session, our Managing Partner Dr. Clemens Hasenauer, LL.M./MBA, who is also in charge of the programme of RuSt, and Univ. Prof. MMag Dr. Sabine Kirchmayr (tax advisor and professor at the University of Vienna) gave a joint lecture on the "Acquisition of interests at times of crisis – distressed M&A". The second opening session was dedicated to "The new dimension of administrative criminal law", with a workshop led by Andritz CFO Mark von Laer, in addition to Martin Oppitz (2O Legal) and CERHA HEMPEL attorney Univ.-Prof. Dr. Peter Lewisch. In the afternoon, CERHA HEMPEL Partner Dr. Hans Kristoferitsch, LL.M. and Jürgen Rassi gave an update on the latest case-law of the Supreme Court relating to the protection of business secrets.
On the second day of the conference, Dr. Hasenauer moderated a panel discussion on "The private foundation as a gilded cage" as part of the closing session. The panel discussed, among other subjects, the influence of beneficiaries on governance, the hardening of the founder's intention, tax issues in comparison to Liechtenstein foundations, as well as the expectations placed on the legislator.
