Fit and proper in practice: When compliance breaches become a personal liability and suitability issue

The fit and proper requirements for managers are no longer merely a formal licensing issue, but are increasingly becoming a personal risk. In current supervisory practice, organisational deficiencies – for example in the areas of governance, compliance or money laundering prevention – are increasingly being individualised and attributed directly to management. This results in personal accusations, supervisory proceedings and potentially far-reaching consequences for the professional future.

In this event, we will discuss the regulatory expectations placed on executives today, how compliance violations become personal fit and proper issues, and how those affected can deal with such situations in practice. Short keynote speeches and a subsequent panel discussion will shed light on the topic from a regulatory, practical and defence perspective and provide space for exchange and discussion.

As part of the ViennaUP week and the Global Digital Asset Forum Vienna, CERHA HEMPEL, together with the Digital Assets Association Austria (DAAA), invites you to an in-depth discussion on asset-referenced tokens under the MiCA framework.

Following last year’s focus on stablecoins, this event turns to the next phase of regulated tokenization. Asset-referenced tokens raise complex legal and supervisory questions at the intersection of financial market regulation, innovation policy and Europe’s competitiveness as a financial center. How are such structures to be legally designed? Where do regulatory boundaries run between MiCA, MiFID and fund law? What liability and insolvency risks arise in practice? And how does supervisory practice shape the innovation landscape?
