CERHA HEMPEL has advised Stadler Bussnang AG ("Stadler") in connection with the ÖBB's tender procedure for up to 20 new fire-fighting and rescue trains ("rescue train project").

The Austrian Federal Railways (ÖBB) will order up to 20 new fire-fighting and rescue trains from Stadler. The two companies have signed a framework agreement in this regard. ÖBB has already placed an initial call-off order for the first five trains.

At the end of December 2020, Stadler and Rail Equipment GmbH & Co KG signed a framework agreement for the development, manufacture, delivery, approval under railway law and commissioning of up to 20 new fire-fighting and rescue trains. The contract is valued at up to EUR 240 million in total. Under the first call-off order, ÖBB will initially order five trains worth approximately EUR 60 million. The first vehicles are scheduled to enter into service by mid-2024 at the latest. The vehicles are intended for interventions in the three new base tunnels of Koralm, Semmering and Brenner and will replace ÖBB's first generation of fire-fighting and rescue trains. They will be able to run on the entire ÖBB route network.

CERHA HEMPEL provided Stadler with comprehensive legal advice during the tender procedure, which was conducted as a negotiated procedure with a prior call for competition.  CERHA HEMPEL Partner Georg Konrad is pleased to have successfully closed the rescue train project despite the extremely difficult environment for negotiations owing to the official restrictions put in place as a result of the COVID-19 pandemic.

The team at CERHA HEMPEL consisted of Georg Konrad (Partner, Corporate/Commercial, Infrastructure), Wolfgang Schreiner (Senior Associate, Corporate/Commercial, Infrastructure), Michaela Kober (Associate, Corporate/Commercial, Infrastructure), and Christopher Peitsch (Senior Associate, Employment).
